Sub-processors

This page lists the third parties BinarBase engages as sub-processors when providing the platform and the Subscription Services. It is maintained and updated in accordance with Article IX subsection 13) of our Terms & Conditions, under which the Client grants BinarBase a general authorisation to engage sub-processors and BinarBase undertakes to inform the Client of any intended addition or replacement of a sub-processor.

Right to object. Where BinarBase notifies the Client of an intended addition or replacement of a sub-processor, the Client may object to that change within fifteen (15) days of the notification by writing to legal@binarbase.com, stating the reasons for the objection. If the Client objects on reasonable data-protection grounds, the Parties shall discuss the objection in good faith; where no resolution is reached, the Client may terminate the affected Subscription Services in accordance with Article XV of the Terms & Conditions.

Notifications of changes. To be notified whenever this list changes, send an e-mail with the subject line "Subscribe — sub-processor updates" to legal@binarbase.com and we will add you to the notification list. Clients with an active subscription are notified at the e-mail address associated with their account regardless of whether they subscribe here.

The first four entries above are sub-processors engaged in the provision of the platform and may process Client Data. The remaining entries concern only visitors to this website and are engaged by BinarBase as the controller; they never receive Client Data, and none of them is loaded unless the visitor gives the corresponding consent (see our Cookies Policy).

Where the Client or its Users do not use the AI Features, no Client Data is transmitted to Anthropic, PBC, and all processing of Client Data takes place within the EU.

BinarBase has concluded a data processing agreement with each sub-processor listed above, imposing data-protection obligations no less protective than those set out in Article IX of the Terms & Conditions, and remains liable for the acts and omissions of its sub-processors as if they were its own.

AI Providers — additional information

In accordance with Article IX subsection 19) and Article X of the Terms & Conditions, the following applies to the AI Providers listed above:

  • Categories of personal data. Any personal data contained in the Inputs submitted to the AI Features. The Client determines what those Inputs contain; the Client is required not to submit special categories of personal data within the meaning of Article 9 of the GDPR unless it has a lawful basis and has notified BinarBase in advance.
  • Purpose. Generating Outputs in response to Inputs and providing the AI Features. No other purpose.
  • No training on Client Data. BinarBase's contractual arrangements with its AI Providers prohibit the use of personal data contained in Inputs or Outputs for the training, fine-tuning or improvement of foundational AI models.
  • Transfer safeguard. Standard contractual clauses pursuant to Article 46 of the GDPR.
